In these terms and conditions, “The Ellternative”, “we”, “us” and “our” means The Ellternative Limited a company registered in England (registered number 10202537) with its registered office at Unit 30, Basepoint Business & Innovation Centre, Metcalf Way, Crawley, West Sussex, RH11 7XX.
1 Access to the website and content
1.1 By using or accessing our website, you agree to be legally bound by these terms and conditions of use as they apply to your use of or access to our website. If you do not wish to be bound by these terms and conditions then you may not use our website.
1.2 We may alter these terms and conditions from time to time and post the new version on our website, following which all use of our website will be governed by that version. You must check the terms and conditions on the website regularly.
1.3 We will try to make our website available but cannot guarantee that our website will operate continuously or without interruptions or be error free and we can accept no liability for its unavailability.
1.4 You must not attempt to interfere with the proper working of our website and, in particular, you must not attempt to circumvent security, tamper with, hack into, or otherwise disrupt any computer system, server, website, router or any other internet connected device.
2.1 An agreement for us to sell you products is made on the basis of these terms and conditions.
2.2 Please note that you must be 18 years or over to purchase products using the payment methods displayed on our website.
2.3 The description of the products, price, currency and delivery costs are set out in the product pages. All sales will be transacted in British Pounds Sterling. You must pay by credit or debit card at the time of order.
2.4 Orders shall be accepted at our sole discretion but are normally accepted if the order reflects current pricing, you are based in a country to which we are currently able to sell and your credit or debit card is authorised for the transaction.
2.5 Once payment has been received, we will confirm receipt and acceptance of your order through our automatic screen confirmation of the order. We will also follow this up with a confirmatory e-mail at the email address you provide at the point of ordering.
2.6 You undertake that all details you provide to us for the purpose of purchasing products from our website will be correct, that the credit or debit card which you use is your own and that there are sufficient funds or credit facilities to cover the cost of any purchases. We reserve the right to obtain validation of your credit or debit card details before providing you with any products.
2.8 Whilst we take the utmost care to ensure that all product descriptions, images and information shown on the product pages are accurate, we do not accept any liability for any inaccuracies, errors or ommissions.
2.9 Due to the handmade nature of the product and particularly the leather material used for the wallet, colour and shape may vary from those shown on the website, with small imperfections occurring due to the natural environment in which the animal lived.
2.10 Any offers we make available are designed to be used independently and are not to be used in conjunction with any other offer.
3.1 Once we have accepted an order and your payment has cleared, delivery will be made as follows:
- We will deliver the products ordered by you to the address you give us for delivery at the time you make your order.
- We use Royal Mail’s second class postal service to deliver the products to you, as standard. Unless otherwise stated, products ordered before 1pm will be posted the same working day (with a working day defined as Monday to Saturday). Orders made after 1pm or on a Sunday will be posted the next working day.
- If your order is placed during our pre-order phase (before and including 6th September 2016), your order will be posted on Wednesday 7th September 2016 using Royal Mail's second class postal service. We cannot guarantee dispatch before this date.
- You will become the owner of the products you have ordered when they have been delivered to you. They will then be held at your own risk and we will not be held responsible for their loss or destruction.
3.2 It is the customer’s responsibility to report all lost deliveries to us within 7 days.
3.3 We shall have no liability to you for any failure to deliver products you have ordered or any delay in doing so or for any damage or defect to products delivered that is caused by any event or circumstance beyond our reasonable control including, but not limited to, strikes or other industrial action, flood, breakdown of systems or snow.
4 Exchange or refund
4.1 If you are a consumer, we will be happy to exchange or refund any products within 7 working days of purchase provided that the products remain unopened and in a saleable condition. To do so you must notify us in writing or other durable medium (including email) within those 7 working days. You will then be entitled to a refund from us, which will be paid as soon as possible, but in any event within 30 days.
4.2 Following a request for exchange or refund, we retain the right to request a return of any products by recorded delivery to The Ellternative Limited, PO Box 69043, London, SW17 1FX.
4.3 If you have any complaints, you should direct them to us via email at email@example.com or by post at the address above.
4.4 This refunds policy does not affect your rights at law, including under the Consumer Protection Act 1987, which cannot be excluded or limited.
5.1 We promise that the products shall meet the specification listed on the website and that they will be of satisfactory quality. We exclude all other express or implied terms, conditions, warranties, representations or endorsements whatsoever with regard to the products, our website or any information or service provided through our website.
5.2 We will do our best to ensure that all materials and information published on our website are accurate, but please note that all materials and information on our website are provided on an ‘as is’ basis.
5.3 You are responsible for ensuring that your computer system meets all relevant technical specifications necessary to use our website and is compatible with our website. You also understand that we cannot and do not guarantee or warrant that any material available for downloading from our website will be free from infection, viruses, worms and/or other code that is harmful or which has contaminating or destructive properties. You are responsible for implementing sufficient procedures and virus checks (including anti-virus and other security checks) to satisfy your particular requirements for the accuracy of data input and output.
5.4 The limitations and exclusions in this clause only apply to the extent permitted by applicable law.

These terms and conditions do not affect your statutory rights (if appropriate) as a consumer.

8.2 We make no representations whatsoever about any other websites which you may access through our website or which may link to our website. When you access any other website you understand that it is independent from us and that we have no control over the content or availability of that website.

9.1 The copyright in the material contained in the website, together with the website design, text, images, graphics and their selection and arrangement belongs to us, our subsidiaries or the providers of such information. All rights are reserved. None of this material may be reproduced or redistributed without our written permission.
9.2 The Ellternative and The Ellternative logo are our registered trade marks. Other organisations (if any) mentioned on this website may be the trade marks or registered trade marks of their respective owners.

10.2 We will contact you at either the email or postal address you provide during any ordering process. If you have entered an incorrect email address and receive no email purchase confirmation and / or any other detail are incorrect then the onus is on you to contact us to amend your details. We cannot be held responsible for the entering of incorrect information or your email service provider spam filtration.
11.1 We may assign, novate or subcontract any or all of our rights and obligations under these terms and conditions at any time.
11.4 Neither you nor we will be held liable for any failure to perform any obligation to the other due to causes beyond your or our respective reasonable control.
11.5 If we fail to enforce a right under this agreement, that failure will not prevent us from enforcing other rights, or the same type of right on a later occasion.
11.6 If any provision of these terms and conditions is held to be unlawful, invalid or unenforceable, that provision shall be deemed severed and the validity and enforceability of the remaining provisions of these terms and conditions shall not be affected.
11.7 These terms and conditions and your use of our website are governed by English law and you submit to the non-exclusive jurisdiction of the English court.
